However, marine repossessions are always complex events made even more so by the myriad bespoke legal issues which present themselves when conducting operations in international waters. Research, preparation and co-ordination play a key role in identifying the likely new and before unseen circumstances that each new operation presents.

Normally the act of surveillance in the form of spotters and site / locality appraisal when combined with pre-event liaison with the relevant local and regional law enforcement and/or military authorities, other cargo interests, consulates, port authorities and insurers (Professional Indemnity, Belligerent Acts, Wilful Acts) can identity and design out the unique challenges on each new assignment.

These inputs inform the preparation and submission of the Operational Method Statement, Safety Statement, Compliance Statement, Medic Statement, Open Water Operations & Dive Statement, Accident Procedure, Anti-Piracy Compliance Statement and the Risk Survey.

Finally the Legal Statement is prepared including Warranties, Indemnities, Waivers, Retention of Title Assessment and Power of Entry (Maritime Acts) Assessment. Derived from these documents the Specialist Equipment List including engineering requirements and firearms assets safety and storage documents are produced.

The actual circumstances of the asset recovery can be broadly classified pre-event as:

  • Scenario: At Anchor – Confrontational – Unarmed;
  • Scenario: At Sea – Confrontational – Armed;
  • Scenario: At Sea – Confrontational – Unarmed;
  • Scenario: Afloat (At Port) – Confrontational; Scenario: Afloat (At Port) – Non-Confrontational;
  • Scenario: Dry Dock / At Anchor / At Sea / Afloat (At Port) – Non-Confrontational;
  • Scenario: Dry Dock / At Anchor / At Sea / Afloat (At Port) – Surrender by Debtor;
  • Abort – All Scenarios;
  • Post event and depending on the location of the operation Storage & Logistics, Repatriation and Post Event Debt Recovery are pre-planned and executed according to client instructions. An "In Progress Discretion" level is always agreed and approved in advance with clients to cater for unforeseen situations encountered on the day of operations.

On client approval and a clear GO from on site surveillance and offsite engineering teams then staging activities commence. On "GO" the vessel is secured and streaming video footage, via satellite links, is transmitted off site to the client for engineering assessments; the asset, crew and other cargo interests are secured and opposing elements are suppressed; the on site team then liaise with Security at Port and notify the vessel status to all interested parties and authorities.

Finally Anti Stand Off Measures / Crowd Control Measures are implemented while the asset is powered up and all parties exit the jurisdiction to the pre-approved staging area.
